BOOKING TERMS AND CONDITIONS AGREEMENT (PART 1)
I. Mandatory Information You Must Know and Understand
DOCUMENTS: US Passports valid for at least 6 months from the date of departure are mandatory for US citizens when traveling to all foreign countries.
IMPORTANT: Non US Citizens (foreign nationals) many countries require visas to enter. It is critical that you consult the Consulate offices of the destination country in order to verify the visa requirements for you to enter that country, and this must typically be done well in advance of travel as some visas can take up to several weeks to obtain.
AIRLINE TICKETS: Most tickets are non-refundable and non-transferable. TRIPFINDER S.A / FATUMTRAVEL.COM recommends purchasing travel insurance in order to protect yourself should you have purchased non-refundable tickets and need to cancel your trip for an unforeseen medical reason.
SURFBOARDS: IMPORTANT- Many airlines charge excess baggage fees for surfboards. Some airlines such as United, Continental and Delta most notably have EXCESS BAGGAGE EMBARGOS to many cities meaning they do not allow surfboards at all on the plane during select times of the year to select cities. Because traveling with surfboards has become a complex matter. You can always order boards with us, for custom made 1 month in advance; we will have your board waiting for you at the airport or at your hotel. TRIPFINDER S.A / FATUMTRAVEL.COM does not offer travel insurance, therefore we recommend contacting your travel agency where you booked your flight for insurance.

BOOKING TERMS AND CONDITIONS AGREEMENT (PART 2)
II. DEPOSIT, PAYMENT, CANCELLATION/REFUND, AND DISPUTE PROVISIONS
DEPOSITS: All deposits and trip payments are non-refundable. Most cancellations due to medical reasons or family emergencies should be covered thru your travel insurance as TRIPFINDER S.A / FATUMTRAVEL.COM does not cover this issue.
PAYMENT: Full payment on all TRIPFINDER S.A / FATUMTRAVEL.COM. Tour bookings are required in our offices no later than 60 days prior to departure. Tour bookings made within 60 days of departure require full payment at time of booking.
CREDIT CARDS: For all TRIPFINDER S.A / FATUMTRAVEL.COM tours cardholders must submit a credit card authorization form either online or by fax or mail. We do not accept credit card payments over the phone. We do not accept 3rd party credit cards except from an immediate family member or from a known corporate customer. We accept Visa, Mastercard only.
CANCELLATION/REFUND POLICY: International surf tours, resorts, camps and boat charters are operations for which space is limited and competitive. All TRIPFINDER S.A / FATUMTRAVEL.COM foreign suppliers are prepaid 30-90 days prior to departure so that they may begin provisioning for your tour. ALL TOUR PAYMENTS AND DEPOSITS ARE NON-REFUNDABLE. There are no refunds or partial refunds given for early departures from a tour or early checkouts from a resort, hotel or surf camp. There are ABSOLUTELY no refunds given for reasons pertaining to surfing conditions or weather conditions. There are ABSOLUTELY no refunds given for reasons pertaining to a global, national, or provincial political situation that does not directly pose a security threat to the safe operations of the tour in the specific region. For your protection, travel insurance is mandatory with all TRIPFINDER S.A / FATUMTRAVEL.COM.
DISPUTES: All claims, legal and otherwise, against TRIPFINDER S.A / FATUMTRAVEL.COM., its officers, directors, agents, employees, affiliated companies, heirs and assignees arising under, in connection with, or incident to this BOOKING TERMS AND CONDITIONS AGREEMENT PARTS 1, 2 AND 3, shall be determined according to the laws of COSTA RICA and shall be adjudicated in the Courts within the jurisdictional geographic boundaries of city of San Jose, Costa Rica , to the exclusion of the courts of any other county, state or country.
In the event that one or more of the provisions of this BOOKING TERMS AND CONDITIONS AGREEMENT PARTS 1, 2 AND 3, for any reason, is held by a court of competent jurisdiction to be invalid or unenforceable in any respect, such invalidity or unenforceability shall not affect any other provision within this agreement and this agreement shall be construed as if such invalid or unenforceable provision had never been contained herein.
BOOKING TERMS AND CONDITIONS AGREEMENT (PART 3)
III. WAIVER OF LIABILITY AND RIGHTS
WHEREAS: TRIPFINDER S.A / FATUMTRAVEL.COM is a booking agent which provides tours, trips and travel packages which are sports oriented, and
WHEREAS: TRIPFINDER S.A / FATUMTRAVEL.COM has no ownership interest in, or control over, the management and/or operations of the tours, trips and travel packages it offers, and
WHEREAS: The parties here to acknowledge that the services provided by TRIPFINDER S.A / FATUMTRAVEL.COM involve surfing, swimming, diving, fishing, boating and water crafting, and other like activities, all of which have inherent risks and are potentially dangerous, and
WHEREAS: The parties here to also acknowledge that travel to, and within, remote areas in Central America and elsewhere and to, and within, all foreign countries, especially third world countries, involves inherent risks which are also potentially dangerous, and
WHEREAS: The inherent risks and potential dangers referred to above may result in damages including, but not limited to, property damage or loss, personal injuries and/or death, and
WHEREAS: The undersigned has been advised to seek independent legal advice regarding the consequences of this Waiver of Liability and Rights, and has been given the opportunity to do so,
WHEREAS: The parties agree that weather and other natural conditions are beyond the control of either party hereto,
WHEREAS: The undersigned, being fully apprised of the above, none-the-less wishes to participate in one, or more, of the services provided by TRIPFINDER S.A / FATUMTRAVEL.COM,
NOW, THEREFORE, for adequate consideration, receipt of which is hereby acknowledged,
- The undersigned here by WAIVES ALL CLAIMS, and RELEASES AND AGREES TO HOLD TRIPFINDER S.A / FATUMTRAVEL.COM HARMLESS for, or from, all damages, whether to the person or property of the undersigned, and
- AGREES to INDEMNIFY TRIPFINDER S.A / FATUMTRAVEL.COM for any claims or obligations arising from the negligence of the undersigned while participating in any services provided by TRIPFINDER S.A / FATUMTRAVEL.COM , and
- AGREES to HOLD HARMLESS and RELEASE TRIPFINDER S.A / FATUMTRAVEL.COM FROM ALL LIABILITY resulting from all unsatisfactory surfing conditions, inclement weather, adverse climate conditions, and/or other natural conditions beyond the control of TRIPFINDER S.A / FATUMTRAVEL.COM which may adversely impact the services provided by TRIPFINDER S.A / FATUMTRAVEL.COM or the expectations of the undersigned.
TRIPFINDR S.A / FATUMTRAVEL.COM is a registered Costa Rican Seller of Travel.
